The common law executive privilege shares roots with law enforcement's need to protect its records, in that there is a "need to minimize disclosure of documents whose revelation might impair the necessary functioning of a department of the executive branch." Id. When applied to law enforcement, this privilege is sometimes called the "government privilege," "official information privilege," or "law enforcement privilege," but still shares terminology and principles with the executive privilege. Torres v. Kuzniasz, 936 F. Supp. 1201, 1209 (D.N.J. 2006)(emphasis added).
