The plaintiff argues that on an application to add a party, there is no lis between the applicant and proposed defendant (Hartoft v. Bell, 2005 BCSC 1723 at para. 8-11, aff’d 2006 BCSC 413 at para. 15). I infer from this argument that costs can only be awarded after the new party is added as a defendant.
