Upon establishing negligence by her lawyer, it was then incumbent on the plaintiff to prove that she suffered damages attributable to that negligence. Her damages will be the sum she would have recovered from the hospital had she succeeded in that law suit had it not been barred by the s. 15 limitation period. In effect, a value must be determined for the lost cause of action (see Wilson v. Rowswell, 1970 CanLII 18 (SCC), [1970] S.C.R. 865).
