At p. 322 Craig J. stated: “The only case cited in support of this proposition is Davidson v. Cooper et at. (1844), 13 M&W 343,153 E.R. 142. While the principle expressed in that case may have been appropriate in 1844, it is, in my opinion an anachronism in 1976, and, as it is not binding upon me, I would not have followed it.”
