Under the law of personal services contract, an individual is entitled to reasonable notice of termination. Damages for failing to provide that notice are determined as payment in lieu of notice – the income the employee would have earned during a notice period, sometimes described as “payment of remuneration for the notice period” (Vorvis v. Insurance Corporation of British Columbia, 1989 CanLII 93 (SCC), [1989] 1 S.C.R. 1085 at para.13).
