12 It is inevitable that another judge undertaking the same exercise might have reached a different apportionment of responsibility for the costs of the trial. But, as the matter is one of discretion and as the trial judge did approach the case in that way, I do not consider myself bound by the judgment of this Court in Bailey v. Victory.
