The discretion to grant the amendment after expiry of the limitation period, however, is to be exercised judicially in accordance with the evidence adduced, and which might address the extent of the delay, the reasons for the delay, any explanation put forward to account for the delay, and the extent of the connection if any between the existing claim and the proposed new cause of action: Amezcua v. Taylor, 2010 BCCA 128.
