Based on R v. Proulx, (2000) SCC 5, I conclude that a conditional sentence is an open alternative for me in this case in that there is no minimum sentence specified for perjury, gaol time may not be appropriate for this Accused, and this Accused poses no danger to society given that I conclude that this is an isolated incident in her life based on the extenuating circumstances that faced her in the interim custody hearing.
