The following excerpt is from R. v. Penner, 2009 ABQB 535 (CanLII):

Although I have been directed to no authority indicating that probation is off the table where an offender is convicted of dangerous driving causing death, I question whether it has the same effects and benefits as a conditional sentence order. Probation orders in this context would likely be seen further to a period of incarceration; however, in certain circumstances courts have granted a purely probationary sentence: R v. K.P. [2001] O.J. No. 4492 (Ct.).
