In a decision Bouviere v. Levesque 2009 SKQB 382, 74 R.F.L. (6th) 311 Justice Dufour comments that the fundamental question regarding whether or not a custody and access assessment ought to be ordered is at para. 8 “whether the trial judge would find a custody and access assessment to be of assistance in determining the nature of custody and access arrangement that is in Wyatt’s best interests. In other words, would an assessor bring something to the table without which the trial judge will be unable to determine what is in Wyatt’s best interests”.
