[1] [2] Officer Lannom initially stopped defendant based on his belief that defendant had violated Sacramento City Code section 10.20.040, which requires a pedestrian to walk on a sidewalk if one is available. Defendant cites People v. McNeil (2002) 96 Cal.App.4th 1302, 118 Cal.Rptr.2d 54 to support his argument that the Vehicle Code preempts local regulations of pedestrian conduct and makes his actions lawful. We agree.
