6 The statute was later amended as part of the transition to the Determinate Sentence Act. As a result of those amendments, the original second sentence of the statute which contained cross-references to other Penal Code sections [was deleted]. (Stats.1976, ch. 1139, 264, p. 5137; Stats.1977, ch. 165, 11, p. 644.) (People v. Latimer (1993) 5 Cal.4th 1203, 1207, fn. 1, 23 Cal.Rptr.2d 144, 858 P.2d 611.) These amendments are not relevant to the present appeal.
