The following excerpt is from United States v. Singh, 877 F.3d 107 (2nd Cir. 2017):
4 "The particular weight to be afforded aggravating and mitigating factors is a matter firmly committed to the discretion of the sentencing judge. " Broxmeyer, 699 F.3d at 289 (quoting United States v. Fernandez, 443 F.3d 19, 32 (2d Cir. 2006) ). In reviewing for substantive reasonableness, "we do not consider what weight we would ourselves have given a particular factor," but instead we determine whether a factor relied on by a sentencing court "can bear the weight assigned it under the totality of circumstances in the case." Cavera, 550 F.3d at 191.
