The following excerpt is from People v. Superior Court (Grilli), 148 Cal.Rptr. 740, 84 Cal.App.3d 506 (Cal. App. 1978):
Drawing all reasonable inferences in favor of the information, it is clear that defendant had the intent, expressed by word and deed during the course of the conduct for which he was committed, to murder the victim. It is equally clear that defendant made a direct and unequivocal act toward that end by twice choking the victim into unconsciousness. It is reasonable to infer that defendant was dissuaded from killing her the second time he choked her only by the arrival of other people (People v.
