To transfer real property to the custodial parent does not provide cash monies for the children. Rather it provides a direct benefit to the parent, but only a peripheral benefit to the children. In some cases where there is no possibility of obtaining maintenance monies for the children it may be appropriate to obtain some benefit for the family unit by effecting an unequal division of matrimonial property as was done in Lawrek v. Lawrek, [1992] Sask. D. 1670-01. However, this should be a last resort. As well, the situation may be different where spousal support is involved.
