This is probably an extreme statement of the rule. See Rudd v. Lascelles [1900] 1 Ch. 815, 69 L.J. Ch. 396. But where the value of the interest which the vendor can convey is reasonably capable of being ascertained, from the evidence of competent persons, the purchaser is entitled to take it.
