In Dadashzadeh v. British Columbia 2003 BCCA 463 Madam Justice Rowles concluded that the same five principles apply to an extension of time to take a step necessary in the prosecution of an appeal, but, in such a case a single justice has no jurisdiction to refuse an extension if the sole ground for refusing the extension is that the appeal has no merit.
