The critical issue here is the standard of care because it defines the content of the duty of care and guides the court in determining whether a defendant’s act or omission breached the duty: Ryan v. Victoria (City), 1999 CanLII 706 (SCC), [1999] 1 S.C.R. 201 at para. 25. There is no dispute Hub was required to exercise the standard of care expected of an ordinary, reasonable and prudent insurance broker in the circumstances. The question is what does that mean here.
