To establish liability, a plaintiff must show that the condition or hazard that caused her fall existed due to a breach by the defendant of this reasonableness standard of care (Van Slee v. Canada Safeway Limited, 2008 BCSC 107, at para. 31.)
In determining if a winter maintenance system is reasonable, courts will consider the specific weather conditions, the state, nature and use of the premises, steps taken to make the premises safe, and foreseeability of risk, Waldick v. Malcolm, 1991 CanLII 71 (SCC), [1991] 2 S.C.R. 456, at pp. 477-478.
