The Simplified Procedure Rule is not reserved for simple debt cases and the like. It is the procedure that is meant to be simple, not the cases. See: Keddy v. Clerica, [2002] O.J. No. 4984 (Ontario Superior Court of Justice). Rule 76 in Ontario and 75.1 here were put in place to reduce the cost of litigation by reducing the amount of procedure available to the parties. The main features of the Rule are the elimination of examination for discovery, the elimination of cross-examination on affidavits filed on motions, the availability of summary trial, and a lower threshold for summary judgement.
