Authorities, and specifically the case of Gordon v. Goertz, 1996 CanLII 191 (SCC), [1996] 2 S.C.R. 27 have held that the custodial parent has the right to move (assuming no bad faith motive) and to take the children along. This right is subject to the court's discretion in each case if circumstances warrant a different result. In that case a mother was allowed to take the children to Australia.
