In my view, this case is to be determined based on the responsibility of a driver to others using the roadway for an uncommon purpose. It is not in dispute that drivers owe a common law duty to take reasonable care for the safety of others and themselves when using a roadway: Wotherspoon v. Hameluck, 2014 BSCS 2137 at para. 16.
