Finally, the respondent cites Kirk v. Kirk et al, 2007 BCSC 67. In that case, Madam Justice Arnold-Bailey found various legal and financial concerns that created a risk of significant prejudice to the wife should she become an ex-spouse at that point in time. In coming to that conclusion the judge also noted that the trial was to commence just four months hence, finding that there was minimal prejudice arising due to a delay in making a divorce order as compared to the potential prejudice that the wife might suffer if a divorce order were to be made.
