Because securities legislation has generally been upheld as falling under head (13), "Property and Civil Rights in the Province", the argument before us focussed on that provision which was also the principal foundation of the judgment of Rand J., concurred in by Kerwin C.J.C., Kellock and Cartwright JJ., in Attorney-General for Ontario v. Scott, 1955 CanLII 16 (SCC), [1956] S.C.R. 137. I say "principal foundation" because Rand J. also founded on head (16).
