In reply submissions, counsel for the plaintiffs submitted that the plaintiffs brought connected claims arising out of a common set of facts against a company and one of its principals and again reliance is placed on Skye v. Matthews where the trial judge dismissed the action against one defendant, but found the other defendant liable. For the reasons already stated, that case is distinguishable and not of assistance on this issue.
