In another scaffolding case, Bodnarchuk v. Dearin Estate, [2002] B.C.J. No. 3096, the plaintiff fell from the scaffolding while attempting to paint the defendant’s house. The plaintiff was a tenant of the defendant who was hired by the defendant to paint the house. At the defendant’s request, the plaintiff assisted in the assembly of the scaffolding. The plaintiff then commenced painting the defendant’s home. Over the years the plaintiff had used scaffolding on other painting jobs.
