Concerning the pension, it's generally agreed that this is in the nature of insurance. There appear to be no cases that provide me some assistance to try and determine whether I need to apply the Ratych rules [Ratych v. Bloomer, 1990 CanLII 97 (SCC), [1990] 1 S.C.R. 940]. However, as I consider the matter, I am of the view this does fall into the Ratych exception. This is a "paid for" insurance policy against disability required by the plaintiff as mandated by the federal pension legislation. Therefore, no deduction will be given in regard to it.
