In Law Society of Upper Canada v. Thomas, 2014 ONLSTH 208, the panel considered a number of cases where, as here, there was a failure to co-operate that was remedied prior to the hearing, and in which the respondent had a discipline history. After reviewing the cases provided, the panel found (at para. 35) that the jurisprudence established that a suspension in the range of one to two months is ordinarily ordered for a second failure to co-operate in an investigation. A similar finding was made in Culliton, above at para. 55.
