The notice of application here is based on a change in circumstances. The change in circumstances is, in fact, the result of new evidence filed by the defendant supporting a different supervision plan. Thus, the requirements for the introduction of new evidence, outlined in Palmer v. The Queen, 1979 CanLII 8 (SCC), [1980] 1 SCR 759, are engaged.
