The Minister made an alternative argument. Even if there was a "transfer to a child", that transfer was not of the type covered by s. 73(5). The Minister relied in this regard on the majority judgment of this Court in The Queen v. Paxton,10 in which my brother Robertson J.A. said that in his opinion:
