The following excerpt is from Diaz-Rodriguez v. Garland, 13-73719 (9th Cir. 2021):
To determine whether a conviction under California Penal Code 273a(a) constitutes a conviction for "a crime of child abuse, child neglect, or child abandonment," we employ the now-familiar categorical approach. Under that approach, we ask whether "the least of the acts criminalized by the state statute" falls within the definition of the federal offense. Esquivel-Quintana v. Sessions, 137 S.Ct. 1562, 1568 (2017). If so, the two offenses are a categorical match and the state conviction may serve as a ground for removal. Id.
