Kearney v. The Ocean Accident and Guarantee Corporation Limited, [1942] O.W.N. 167, in which the Master held that the agent Gilpin was not an officer of the company within the meaning of Rule 327(2) even though the Rule provided that such examination shall not be used as evidence at the trial.
