Brown submits that if accrued vacation pay is held in trust, then the claim for vacation pay is tenable since a breach of trust for the purposes of the Limitations Act occurs when the trustee states that it will not be paying out the amounts held in trust: Simpson v. Bridgewater Bank, 2012 ONSC 714, at para. 51.
