This Court discussed the consideration of limitation periods in a motion under Rule 21.01(a) in Kelly v. Canada (Attorney General), 2010 PECA 17, at ¶18-23. In my opinion, in the present case, the limitation period issue is determinative. Unless they commenced their action within the prescribed time limits, the appellants have no case at all for their personal claims. Because the appellants’ action is statute barred, the motions judge proceeded properly in dismissing their action. Likewise, I would dismiss the appeal on that basis.
