The Law Society’s position is that the settlement of the appeal resulted in it being abandoned, and an abandoned appeal is the equivalent of the often quoted statement that a decision is final once “all avenues of appeal have been exhausted”: see, for example Wilson v. The Queen, 1983 CanLII 35 (SCC), [1983] 2 SCR 594 at 599. The Law Society points to the form filed with the court to bring a close to the appeal. The mandatory language of that form provides that the appeal has been abandoned.
