According to the respondents the description of the legal basis of the petition fails to articulate the legal grounds to be advanced in support of the petition and, in particular, the legal grounds advanced by the petitioner at the hearing of the petition are not stated in the legal basis section of the petition. According to the respondents, “… a party should not be left guessing about the case it has to meet” (Polson v. British Columbia (Superintendent of Motor Vehicles), 2014 BCSC 700, at para. 59).
