The following excerpt is from MacMillan Bloedel Ltd. v. Youell, 1993 CanLII 6858 (BC CA):

If the paragraph is confined to liability insurance in the twentieth century, it is probably accurate. The one case is Cunard v. Marten, supra. Since that case there has not been a decision on the question in Canada or England, Cunard v. Marten seems to have been accepted as the law on the subject.
