The key word under s. 18 is the word “available”. There is a substantial difference between the company which is wholly owned and directed by the payor parent and one in which he is not the controlling mind (Kowalewich v. Kowalewich 2001 BCCA 450). Likewise there is also a difference between a company that generates its income solely from the work of the payor (for example, a medical doctor or a dentist) and a company that operates retail stores such as the companies we are dealing with.
