There will here be no complicated medical, scientific evidence, as in Mighton v. Maile, 1986 CarswellBC 34 (S.C.), or other technical evidence introduced by the parties. I am not persuaded length by itself justifies denying the “presumptive right of a jury” and that length will necessarily impact on the representation of the jury any more than in cases of trials of a much shorter anticipated length.
