Before I set out my analysis, I should identify two issues that arose at trial. First, I provided the parties with the decision in Wronko v. Western Inventory. This was a Court of Appeal decision that concerned the question of whether a party could unilaterally change an employment (or similar type) contract. On my initial view of the case, it was possible that this decision might be applicable and I wanted to afford the parties the opportunity to comment on it.
