The issue of actual occupation was discussed in Walcer v. Shmyr et al. (1982), 1982 CanLII 2386 (SK CA), 136 D.L.R.(3rd) 723. It held that even though a person was not a resident on the land he was in actual possession where he had on it a standing crop.
