In Regina v. Dwyer Goodman J. had the British Columbia case before him. He held that s. 504 applied only to grand jury proceedings and also pointed out that the broader provisions in s. 504 were explicable since there is a protection in the grand jury procedure itself. He did not consider whether or not the section might be restricted to included offences, an interpretation which would be justified by Regina v. Miller, supra.
