It is clear that the normal term of a fixed penalty for cases like the one before me is one month. The Good decision offered by the Lawyer for the proposition that 21 days would be more appropriate does not apply. The reduction of the normal one-month fixed penalty in that case was based on mitigating medical evidence. No evidence of this or similar mitigating factors was before me: Law Society of Upper Canada v. Aguirre, 2007 ONLSHP 46.
