The final case relied on by Frances is Mohansh v. Thillainathan [2010] O.J. The medical report filed in that case made it clear that the plaintiff had marked functional difficulties and outlined precisely what they were. It was clear the plaintiff would have little, if anything, to contribute by way of oral discovery. I see that case as wholly distinguishable from the matter before me. CONCLUSION
