As set out in the case of Tae v. Canada[6] I have considered the evidence of the long distance telephone calls, the fund transfer, and the photos of trips and visits. I agree that there is evidence of communication and visits. However, the evidence is not conclusive in itself of the genuineness of a marriage just as a child is not conclusive of a genuine marriage. The appellant and applicant must be credible and significant concerns raised at the hearing must be explained. I find that I am not convinced the appellant and applicant are credible for reasons outlined elsewhere, and significant unexplained concerns remain.
