Newfoundland and Labrador, Canada

The following excerpt is from R. v. W.(S.), 2002 CanLII 36542 (NL PC):

[24] In McMullin v. Ash (1973), 5 Nfld. & P.E.I.R. 315 (N.F.S.C.), for instance, Mr. Justice Puddester succinctly summarized the duty imposed upon a driver making a left-hand turn as follows (at page 320): The duty is plain: a motorist must not turn across the traffic lane of oncoming traffic unless the movement can be made with reasonable safety; and even then he must proceed with caution and yield to oncoming traffic near enough to be a hazard.
