In addition, the defendant cites MacDonald v. McCormick, 2008 NSSC 6, where LeBlanc J. disallowed disbursements claimed on account of witness attendance at discovery and trial. There was no discussion of the issue, however. The defendant says the same principle applies to the plaintiff’s own travel expenses. Having chosen to commence the proceeding in Halifax, he submits, the plaintiff is not entitled to claim a disbursement for travel.
