In a family law case in Oborowsk, in what circumstances have courts found no evidence that the children’s needs are not being met in the current custodial arrangement?

Ontario, Canada

The following excerpt is from Elliott v. Elliott, 2008 CanLII 27033 (ON SC):

[82] In Denis v. Oborowsk, the court found no evidence that children’s needs were not being met in the current custodial arrangement.[14] Further the court received no clear evidence that the children’s lives would be enhanced by the proposed move. The court concluded therefore that there was no evidence to show that the move was being made to meet the needs of the children and the move was not permitted.
