A trial judge is clearly a court of competent jurisdiction, as this expression is utilized in s. 24(1) of the Charter, and superior courts have concurrent jurisdiction to deal with Charter issues, subject to the discretion to decline to exercise the jurisdiction if the trial court is the more appropriate forum: Mills v. R., supra.
