How has the law of delay in filing a motion in a personal injury case been interpreted?

Manitoba, Canada

The following excerpt is from Fegol v. National Post Co. et al., 2007 MBCA 27 (CanLII):

10 The judge explained this law at some length in her reasons and applied it to the facts as she found them. To understand the delay and its factual underpinning, she prepared a detailed chronology of events which starts from the date of the filing of the statement of claim on December 2, 2002, and ends on May 6, 2005, when the plaintiff filed another motion in these proceedings. During this time period, motions involving other defendants were also before the courts. See, for example, Fegol v. Pitblado Buchwald Asper et al., 2005 MBCA 77.
